Article 1 (Purpose is based on)

In order to strengthen the safety supervision and management of the construction of houses and municipal infrastructure projects and protect the safety of people’s lives and properties, according to the regulations of the “Construction Law of the People's Republic of China” and the “Regulations on the Safe Production of Construction Projects” and other relevant laws and regulations, in conjunction with the reality of Chengdu, Formulate this rule.

Article 2 (Scope of Application)

This regulation applies to construction safety and its supervision and management of construction projects within the administrative area of ​​this Municipality.

The term "construction project" as used in these Regulations refers to all types of building construction and municipal infrastructure projects (including decoration and subway works) that are newly built, expanded or rebuilt.

Article 3 (Management Body)

The municipal administrative department for urban and rural construction is the administrative department in charge of the construction safety of this Municipality. It is responsible for the supervision and administration of the construction safety of the construction projects in the city, and entrusts the Chengdu Construction Engineering Construction Safety Supervision Station with specific responsibility for the implementation of supervision and management.

The district (city) county construction administrative department shall be responsible for the supervision and administration of the construction safety of the construction projects within its jurisdiction in accordance with the combination of hierarchical management and territorial management. The district (city) county construction safety supervision agencies may be entrusted with specific supervision and management.

Article 4 (Liability Subject)

All parties responsible for construction, construction, supervision, surveying, design, monitoring, testing and equipment leasing shall perform their duties of safe production in accordance with laws, regulations and rules, implement the provisions for safe production, and assume responsibility for safe production.

Article 5 (Responsibilities of Construction Units)

The construction unit shall perform the following safety production responsibilities:

(a) Sign a safety production agreement with the construction company.

(2) The safe and civilized construction fees will be listed separately in the tender documents for construction projects and shall not be included in the bidding price range of the tenders, and shall be paid in strict accordance with the regulations.

(3) Before construction, inspect the buildings (structures), roads, bridges, tunnels, important facilities, underground pipelines, etc. within the double depth of the foundation pit in the vicinity of the construction project according to regulations, and organize the survey, design, construction, supervision, etc. The unit carries out the safety technology survey of the survey and design documents, and takes corresponding monitoring, reinforcement, protection, isolation, relocation, demolition or other safety measures as required.

(4) Establish a safety and civilized construction management organization at the construction site, formulate a safe and civilized construction management system and assessment methods, clarify the responsibilities of the general subcontracting unit, regularly organize relevant units to conduct safety and civilized construction inspections, and promptly supervise and organize relevant units to eliminate Hidden dangers to security, and comprehensive coordination of safety and civilized construction of multiple construction units working at the same time; implementation of property management on dust rectification at the construction site, and overall responsibility for dust rectification at the construction site.

(5) Organize relevant units to take effective measures to ensure the safety of personnel and entrust professional inspections in a timely manner for safety hazards caused by construction of adjacent buildings (structures), roads, bridges, tunnels, important facilities, underground pipelines, etc. Institutions or accreditation agencies conduct safety appraisals of damaged buildings, roads, important facilities, underground pipelines, etc. to eliminate potential safety hazards.

Article 6 (Responsibilities of Investigation and Design Units)

Surveying and designing entities shall perform the following safety production responsibilities:

(1) Conduct surveys and designs in accordance with mandatory standards for project construction, and provide survey reports and design documents that are true and accurate. Engineering design shall consider the need for safe operation and protection of construction. The key parts and links involving construction safety shall be indicated in the design documents.

(2) According to the needs of safe production and emergency rescue at the construction site, cooperate with related units to promptly propose handling measures.

(3) Responsibility for production safety accidents due to investigation and design reasons.

Article 7 (Supervision Enterprise Liability)

The supervision enterprise shall perform the following safety production responsibilities:

(1) Equipped with special safety supervisors for engineering projects, establish project safety supervision files, and regularly report safety supervision to construction safety supervision agencies.

(2) Review the construction organization design and special construction plan. Without the review and signature approval of the supervisory engineer, if the construction company is arbitrarily constructing, immediately suspend the construction instruction and report the situation to the construction unit in writing.

(3) After reviewing the qualification certificates and safety production licenses of the entering construction companies, they may sign the construction instructions. A written record of the safety management personnel in the general contracting and professional subcontracting units is provided.

(4) Including the engineering construction of the dangerous part of the project into key monitoring, and implementing the supervision of the side station on the key parts and links involving construction safety.

(V) Participate in the inspection and acceptance of construction machinery and safety facilities, supervise the construction unit to conduct safety inspection on the construction site, and eliminate hidden dangers in time.

(VI) In the process of inspection and inspection of supervision, if any hidden danger of safety accident is discovered, written instructions shall be issued immediately to require the construction enterprise to carry out rectification or stop the construction. Where a construction company refuses to make rectification or does not stop construction, the supervision enterprise shall report the situation to the construction unit and the construction administrative department in a timely manner.

Article 8 (Responsibility of Construction Enterprises)

Construction companies shall perform the following safety production responsibilities:

(1) Set up a safety production management organization and staff with full-time safety management personnel, establish a person in charge of the company and the person in charge of the project to carry out the construction on-the-job training system, organize safety production inspections on a regular basis, and conduct strict inspections.

(2) Project managers, safety engineers and full-time safety personnel are assigned to the project as required. The project manager is the first person responsible for the safety production of the project, and is responsible for the overall safety of the project. The safety engineer is responsible for the safety management of the project.

(3) Compiling the construction organization design according to the scale and characteristics of the construction project, and the foundation pit support, precipitation project, earth excavation project, formwork project and supporting system, hoisting and installation and disassembly, scaffolding, and building curtain wall installation Engineering, artificial digging piles, underground excavation, pipe jacking, and other dangerous parts of the project to prepare a special construction program, the construction company technical person in charge of construction organization design and special construction plan for review.

(4) Establish a project subcontracting enterprise list, review the qualifications of professional subcontracted enterprises, safety production licenses, safety management personnel, special operating personnel and other relevant documents, sign professional subcontracts, and perform the general subcontracting management responsibilities in accordance with regulations.

(5) The professional subcontracting enterprises shall earnestly perform the responsibility for safe production, allocate the full-time project safety management personnel in accordance with the regulations, and actively cooperate with the general contracting enterprises for unified and coordinated management.

Article 9 (Daily management of construction site)

Safety management at the construction site shall meet the following requirements:

(1) “Five-card and one-drawing plan”, such as hanging the project overview card, management personnel list, supervision complaint phone card, fire protection card, safety production card, civilized construction card, construction site plan, etc., at the construction site entrance and exit; The payment of migrant workers' wages and supervision of the telephone.

(2) Reasonably lay out the general construction plane and clearly divide the construction work area, office area and living area. The construction site entrances and exits and main roads shall be hardened and kept unobstructed. Significant zoning marks shall be made between entrances, main roads, and material stacking areas, and “yellow line” management shall be implemented.

(3) The project department of the construction enterprise shall arrange for construction personnel who have received safety education and safety technical disclosure and have passed the assessment to go on duty. The personnel engaged in special operations shall also pass the assessment by the construction administrative department.

(4) The project department of the construction enterprise shall do a good job in daily records of construction safety, establish safety data files, and make special records for the more dangerous partial projects.

(5) The construction company's project department shall organize the construction in accordance with the construction design and special construction plan approved by the enterprise technical person in charge, and shall strictly follow the construction safety technical standards and safety operation rules for construction operations.

(6) The construction site shall take effective measures to ensure public safety, and the safety protection facilities provided shall comply with relevant standards and promote the use of tool-type safety protection facilities.

(7) The temporary use of electricity on the construction site shall comply with relevant regulations to ensure that the power transmission and distribution facilities and the transmission and distribution lines are in a safe and reliable state.

(8) Before the use of construction machinery, machine tools and electrical equipment, inspections and inspections shall be carried out in accordance with the relevant provisions; during use, special personnel shall be designated to take charge of maintenance and maintenance to ensure its integrity and safety.

(9) The construction site shall abide by the relevant provisions on fire safety and ensure the integrity and effectiveness of the fire fighting facilities.

(10) Responsibility parties of all parties to a construction project shall strengthen inspections and inspections of safety at the construction site, discover hidden dangers of safety accidents and violations of construction safety technical standards or safety operation regulations, and shall promptly stop or correct them.

(11) The construction site shall implement digital information system management in accordance with the management requirements of “Digital Urban Construction”.

Article 10 (Lifting Machinery Management)

Construction cranes used on the construction site shall meet the following requirements:

(1) Lifting equipment rental units and self-purchased lifting machinery use units shall establish and improve the enterprise's safety production management system, perform management duties, establish a sound building safety machinery safety technology file and monitoring system, and use the expiration of eight years. The hoisting machinery establishes key monitoring files and provides regular safety inspection reports.

(II) Before the leasing of the lifting equipment, the using unit of the lifting equipment purchased by the leasing unit shall, prior to the first installation of the lifting equipment, handle the filing in accordance with the relevant regulations; if the property right of the lifting equipment is changed, it shall be handled according to the regulations. Or re-file. Chengdu Construction Engineering Safety Supervision Station shall publish the list of registered rental units to the public.

(3) Before installing and dismantling lifting machinery, the installation unit shall notify the competent administrative department of construction according to the regulations.

(4) The using unit shall handle the registration of use within 30 days from the date of qualified acceptance of the lifting appliance installation.

(5) The lifting appliances shall be equipped with special operators such as disassembly and disassembly workers, lifting signal workers, lifting drivers, and cable workers in accordance with the regulations, and shall implement the management of “definite person, fixed machine, and fixed posts”.

(6) Where the operating range of lifting machinery exceeds the fence of the construction site, the construction enterprise shall formulate special safety technical measures.

Article 11 (Risk Control)

The responsible parties of construction projects should strengthen the awareness of risk control of construction projects, formulate risk prevention and control measures for construction projects, carry out safety education on a regular basis, and provide insurance for employees at construction sites and hoisting equipment that is prone to casualties.

Article 12 (Labor Protection)

Construction companies should abide by laws and regulations concerning occupational health and safety and strengthen occupational health work. The construction enterprise shall distribute the labor protection articles that meet the regulations for the construction site operators and urge them to use them properly. When purchasing construction materials for labor protection, the construction company shall check whether the product has an inspection report issued by a statutory inspection agency, and carry out sampling inspection according to regulations. Do not purchase labour protection items that have not been provided with an inspection report or failed to be spot checked.

Article 13 (Review of Safe Construction Measures)

A construction company shall apply for a review of safety construction measures before starting construction and file safety supervision records. A construction company that has not passed a review may not start construction.

Article 14 (Safety Supervision and Inspection Contents)

Construction safety supervisory agencies will conduct random inspections on the safety production of construction sites that have been registered for safety supervision. The main contents of supervision and inspection are the circumstances in which the parties responsible for sampling, construction, supervision, construction and other parties perform safety production duties. And the construction site safety production entity protection status. If any non-compliance with prescribed safety production behaviors or hidden safety hazards at the construction site is found, it shall be ordered to correct immediately and the safety hazards shall be eliminated within a time limit. If the circumstances are serious or have not been corrected within the time limit, the construction administrative department shall be required to suspend the construction.

Article 15 (Credit Management)

The construction administrative department shall, in accordance with the daily supervision and spot checks, record the adverse actions of the parties responsible for the construction of the project construction site in the credit information system as one of the basis for the qualification of the enterprise, the safety production license, and the qualification management of the employees.

Article 16 (Accident Investigation and Treatment)

If a production safety accident occurs on the construction site, the construction company shall report to the construction administrative department and the relevant department in a timely and truthful manner in accordance with the relevant national accident casualty report and investigation and handling regulations. The competent administrative department of construction shall order the shutdown and rectification of engineering accidents involving production safety accidents, and shall participate in the investigation and handling of production safety accidents in accordance with relevant regulations; the construction safety supervision agency shall assist the relevant units in technical analysis of the accidents.

Article 17 (Administrative Penalties)

The violations of these regulations shall be handled by the competent administrative department of construction in accordance with the following provisions:

(1) In case of violation of the first item, the third item, the fifth item of Article 7, the first item of the eighth item, the fourth item of the eighth item, the third item of the ninth item, and the seventh item, the order shall be ordered to be rectified within a time limit; A fine of more than 5,000 yuan but less than 10,000 yuan is imposed.

(2) Violations of the provisions of Article 5, Article 3, Article 7, Item 4, Article 9, Item 4 and Item 6 shall be ordered to be corrected within a time limit, and a fine of 10,000 yuan up to 20,000 yuan shall be imposed concurrently; , Order to stop work and rectification, and report to the construction administrative department at a higher level to lower the qualification level or revoke the qualifications.

(3) Violators of the provisions of Article 5, Article 5 and Article 9, Paragraph 5, shall be ordered to make corrections within a specified time and imposed a fine of 20,000 yuan up to 30,000 yuan; if the circumstances are serious, they shall be ordered to stop work for rectification, and shall be reported to the competent construction administration at a higher level. Reduce the qualification level or revoke the qualification.

(4) Where the principal responsible person or project leader of a construction enterprise fails to perform the responsibility for safety production management and causes a major safety accident, major casualty accident or other serious consequences, if it is not serious enough for criminal punishment, it shall be in accordance with the Sixth "Regulations on the Safe Production of Construction Projects". Article 16 shall impose a fine of 20,000 yuan up to 200,000 yuan or dismissal in accordance with the powers of administration; from the date of the penalties, no person in charge of any construction unit may be held responsible for the construction of the project within five years; If a crime is committed, criminal responsibility shall be investigated according to law.

If there are provisions in other laws, regulations, and regulations that have violated the provisions of this regulation, these provisions shall prevail.

Article 18 (Qualification of suspension of practice)

If a general production safety accident occurs on the construction site, the project manager in the city shall be suspended from the project manager qualification for six months to one year, and the supervision engineer of the project director shall be suspended for three months.

If there are major or more production safety accidents on the construction site, suspend the project manager's qualification for the construction engineer in the city for one to two years, and suspend the supervision engineer of the project chief supervision engineer in the city for six months to one year; the circumstances are serious. , To the superior construction administrative department to revoke the project manager qualification certificate of the construction engineer and the supervision engineer of the project supervision engineer qualification certificate.

Article 19 (Suspended Tender)

If a production safety accident occurs on the construction site, the following rules shall be used to suspend the bidding qualification of the construction and supervision enterprises in this Municipality:

(1) If there is a general accident, the bid shall be suspended for one to three months;

(2) If there is a major accident, the bid suspension shall be for three to six months;

(3) If a major accident occurs, the bid shall be suspended from six months to one year.

Article 20 (meaning of terms)

The term “side station supervision” as used in these Regulations refers to the supervising activities of the supervision personnel in the supervision of the construction phase of the house construction project and the on-site supervision of the key processes and key processes during the entire process of implementation.

The term “property management” as mentioned in these Provisions refers to the way in which the owner and the realty service enterprise perform repairs, maintenance, and management of the construction project construction site in accordance with the real estate service contract stipulations by selecting and employing a realty service company or a professional real estate management team. Maintaining environmental health and related order activities within the property management area.

Article 21 (Date of Implementation)

This regulation shall come into force on August 1, 2012.
